Smart Trial Lawyers Ask for Help
After my last trial (click here), several jurors mentioned to me that I really helped pull back the curtain and crystallize the issues by something I said during closing argument. They were referencing a metaphor I used…
“The defendant ambulance company played ‘private ambulance Russian roulette.’ They knew that there would be a time when the restraints would not work and they crossed their fingers every time they used them –hoping this wouldn’t be the bullet that would kill.”
Here’s a little secret. The idea for this metaphor wasn’t mine. It was given to me by best-selling author, speaker, and consultant, Anne Miller. As in all of our trials, Lisa and I look to outside resources to bring a fresh view or perspective on the facts and issues. Without exception, this always helps us make our point to the jury.
In this case and during trial preparation, I shared the facts of my case with Anne and we tossed around several different thoughts and ideas. She then came up swinging with this million dollar home run of a metaphor.
