One of the more rewarding motorcycle accident cases our office has handled over the years involved a case that Lisa handled. It took a great deal of work and effort but in the end, she was able to help, as best possible, a veteran of our Special Forces. Here are the case facts…

Our client had served in the Special Forces for 30 years. After arriving home in Los Angeles, he was riding his daughter’s motorcycle. While doing so and through no fault of his own, he sustained serious injuries and damages after being struck by a car being driven by an inexperienced 16-year-old driver (defendant). At the time of the collision, the defendant had a three week provisional license and two 15-year-olds illegally as passengers and distracting her attention from the road.

Our client approached and entered an intersection at the posted speed limit and on a green light. At the same time, the defendant unexpectedly and abruptly turned left on a red arrow, directly in to the path of our client’s motorcycle, causing this horrific collision. The defendant admitted fault at the scene of the collision to the investigating officer, indicating that she only realized she’d run a red light after initiating her turn.

California motorcycle accident lawyers and attorneysAs a result of the impact, our client slammed in to the side of the defendant’s vehicle and then flipped over the top of the car. He then struck his head on the car and on the pavement, causing a head injury despite wearing a helmet. Our client suffered a loss of consciousness and ongoing memory issues. He was taken to Harbor UCLA Medical Center where he underwent numerous surgeries and treatment for his injuries. In addition to his head injuries, our client also suffered the following injuries:

  • Left hand was nearly severed with bones shattered, requiring multiple surgeries, including wrist reconstruction and permanent loss of strength and mobility;
  • Broken eye socket;
  • Broken nose;
  • Broken neck;
  • Broken teeth (including gum damage) and loss of teeth, now requiring braces;
  • Multiple facial lacerations- his upper lip was nearly ripped completely off and required reconstructive surgery, leaving him scarred;
  • Left shoulder dislocation;
  • Broken collar bone which is permanently displaced causing severe pain and limited mobility;
  • Broken ribs;
  • Shattered pelvis together with pelvic muscles torn and shredded requiring surgical reconstruction including a metal plate and resulting in impotency;
  • Compound fracture of his left leg requiring surgery including steel rod placement from his ankle to his knee;
  • Broken ankle; and multiple lacerations and contusions all over his body.

The insurance carrier for the other side tried to argue that their insured driver was not at fault. The insurance company’s initial settlement discussions were so low, they were insulting.

In response, Lisa filed a Superior Court lawsuit to protect her client’s interest. During the litigation process, depositions were taken. At the deposition of the investigating police officer, he confirmed that at the scene of the collision, the defendant driver admitted fault. During her deposition, Lisa was also able to get the defendant to admit that she saw our client on his motorcycle approaching the intersection but thought she could “beat him” and turned left in front of him.

During the discovery phase of the case, Lisa also confirmed that an independent witness stopped at the intersection at the time of the collision and unequivocally confirmed that the defendant pulled directly in front of our client.

Defendant’s Parents Also Responsible:

In addition to the liability of the defendant for running a red light and causing this accident, her parents were also alleged to be liable for negligent supervision. Both parents knew, or should have known, that their daughter was illegally driving with other minors in the vehicle. In fact, this was not the first time she had done this. Regardless of this known fact, they provided the minor defendant with her own set of keys and left the vehicle and the keys available to her without restriction or supervision.

In addition to their automobile insurance liability coverage, the parents also carried an supplementary liability umbrella policy in the amount of $1,000,000.00.
At the end of the day and shortly before trial, Lisa was able to settle her client’s motorcycle collision case for the defendant driver’s $250,000 automobile liability together with payment of her parents’ $1,000,000 liability umbrella policy.

Case Update- $250,000 Motorcycle Accident Policy Limits Settlement- Bishop, California

[Update: Bishop, CA: August 20, 2012]

Bishop California Motorcycle Crash LawyerOur client was riding his Kawasaki Ninja 650 eastbound on North Sierra Highway at approximately 45 miles per hour just outside of Bishop, California. The other driver was Dodge 3500 truck and stopped southbound on Brockman Lane at a stop sign. Without warning, the Dodge pulled out directly in to the path of travel of our client and causing this collision.

According to the investigating police officer, the driver of the Dodge was found at fault for the collision and in violation of California Vehicle Code section 21802(a), which states in part, “The driver of any vehicle approaching a stop sign at the entrance to, or within, an intersection shall stop at a limit line, and yield the right-of-way to any vehicle which have approached from another highway. D-1 failed to yield the right-of-way to Vehicle #2 (Kawasaki).”

As is usually the case in the motorcycle claims we handle, our client sustained major injuries including an open fracture and deep lacerations to his lower left leg. After several surgeries, we are now happy to report that he is now doing fine.

Our wonderful client was patient and never rushed us. He let us do our job. Now here’s the good news– after negotiating and reducing his mandatory health insurance lien obligations, we were able to save our client $156,308.26. Then, after completing an asset background check to confirm that the other driver did not have any other available liability insurance and, after confirming the other driver was not in the scope and course of employment (this may have allowed us to seek additional benefits through his employer), we were then able to settle our client’s case with a major insurance carrier for other driver’s $250,000 policy limits.

The facts of his collision are similar to a motorcycle accident case we handled a few years ago. Here are the facts…

Client Loses Leg After Being Hit While Safely Riding His Motorcycle

Our client was out for a relaxing late morning motorcycle ride on the winding Big Bear highway near Big Bear, California. He was doing everything right.

He was riding his motorcycle at a safe speed and in a very careful fashion. He was alert and cautious always watching for “the other guy”.

motorcycle accident lawyerWithout warning, a vehicle coming downhill and from the opposite direction crossed over the double yellow center lines and struck our client from the side. Our client sustained major injuries which included left side injuries, head trauma and a severed left leg just below the hip.

The driver who caused this collision was arrested and prosecuted criminally and convicted of violating California Vehicle Code 23153(A) which is driving a motor vehicle while under the influence of alcohol or drugs. As a result of his conviction, the defendant was also ordered to serve jail time and also pay restitution to our client.

Most of you know that I’ve been riding and racing motorcycles for most of my life. And if you follow my blog posts, you also know that I have zero tolerance for negligent drivers who cause motorcycle accidents and injuries.

We took our passion for riding and focused it towards helping this injured client. At the same time the criminal case went forward, we filed a civil case against the careless driver and aggressively litigated the matter. Eventually, before trial, we were able to obtain a $2,000,000 settlement and stipulated judgment for our client.

Special Note to Motorcycle Riders

As you know, the bike you’re riding is much smaller than most cars and trucks. When a collision happens, you have little, if any protection.

According to recent National Highway Traffic Safety Administration (NHTSA) figures, the number of motorcycle fatalities continue to increase each year. The economy, rising gas prices and aging baby boomers result in over a million bikes being purchased each year in the United States.

Speeding is the number one cause of fatal motorcycle accidents. Most fatality collisions take place on undivided highways.

As a rider who’s “been there and done that,” my take is that these increased numbers reflect a combination of a lack of rider education, training, inattention, excessive speed and/or third-party negligence (the driver of another car or truck was careless and caused the accident). Crowded roads and drivers using smart phones and texting probably doesn’t help either.

Even while I write this blog post my knees hurt from years of abuse on the motocross tracks. But that’s OK. I’m lucky. After all, if that’s my biggest motorcycle related injury, then I guess I don’t have too much to complain about.

Too Many Motorcycle Riders Become Accident Victims

Because of the physics involved in motorcycle accidents, the extent of personal injury or death is unusually high. In fact, the National Highway Traffic Safety Administration (NHTSA) recently released new statistics showing that motorcycle fatalities have increased for the seventh year in a row. With more than 1,000,000 motorcycles being purchased each year (this figure has increased each of the past 14 years), the additional number of riders has resulted in fatalities increasing at an alarming rate of 89% from 2,116 in 1997 to 4,008 in 2004.

The numbers reflect that the average age of these riders is 20-29, with speeding being the number one cause of these fatal accidents. According to Motorcycle Industry Council findings, there is a high increase in the number of motorcycles purchased by riders over the age of 40 and a corresponding increasing number of fatalities with riders in this age group.
The highest percentage of fatal motorcycle accidents involved alcohol. More than 72 percent of these riders were in the age group of 40-49. One positive aspect of this statistic is that the number of alcohol related fatalities has actually decreased over the past 10 years.

More than 70% of motorcycle fatality accidents take place on undivided highways. I would suggest that this is a combination of a lack of rider education, training, inattention, excessive speed or third-party negligence (the driver of another car or truck was careless and caused the accident).

Another disturbing but not necessarily surprising statistic is that about 80% of all motorcycle accidents result in injury or death. This statistic reflects the fact that regardless of fault, there is little protection for a motorcycle rider in an accident. Unfortunately, the pain I feel in my knees, back and right shoulder while writing this article are a constant reminder to me of this very real fact.

Several Interesting Recent Settlements…

Automobile Accident Lawyers in CaliforniaEarlier this month we had the opportunity to help several clients resolve their personal injury cases. Both matters involved one to two years of litigation and both cases were settled shortly before trial.

Motorcycle vs Semi-Trailer Truck ($375,000)

In the first case we represented a motorcycle rider who was seriously injured after being involved in a collision with a large semi-trailer truck. Our client was safely and lawfully proceeding down a road on his way home from work. He observed the semi-trailer truck parked on the side of the road and well ahead of him.

As he approached the area where the truck was parked, the truck began to move forward and pulled on to the roadway. Our client believed the truck was simply going to unsafely merge in to the far outside lane and continue with its direction of travel. Our client changed lanes and continued traveling forward in the lane closest to the center section of the road.

What happened next turned in to a life-changing nightmare. Rather than continue moving forward, the truck unexpectedly attempted to make an illegal u-turn directly in front of our client and other approaching vehicles. Our client was very attentive and rather than slamming into the side of the truck, he put his bike down and slid underneath the trailer section of the truck avoiding a direct impact. Had he not done so, our client was have sustained fatal injuries on impact.

Our client described his actions as the type of thing you might see in a movie– a movie he wishes he was never in.

Unfortunately, when he slid underneath the trailer, his shoulder struck a low hanging piece of metal that resulted in him sustaining major injuries to his shoulder and other body parts. During the fall, our client also sustained other serious injuries relating to bruising and road rash.

 

Automobile Collision ($100,000)

In another case, our firm represented a wonderful elderly woman who was a negligent free passenger in the back seat of a Land Rover being driven by her son-in-law. After the driver fell asleep at the wheel, the vehicle collided in to the back of a truck that had stopped on the freeway.

Despite being seat belted in, the force of the collision resulted in our client sustaining injuries to her knees, shoulder, face and mouth.

Before this collision, our client enjoyed traveling and being active. After the collision she suffered constant pain and had to change her daily habits.

The good news is that with the assistance of a very experienced retired Superior Court Judge and outstanding Judicate West Mediator, we were able to resolve the case one week before trial. We’re also happy to report that all is well between our client and her son-in-law.
