According to the National Council of Insurance Institute, personal injury and wrongful death claimants who hire experienced lawyers may receive 300% higher settlements. In our experience, this number may actually be substantially more.
Please note that each case is different and past results do not guarantee what will or will not happen with your case. Having said that, here are just a few of the cases that we’ve handled over the past 25 years where we were able to substantially increase the full value of the outcome.
Wrongful Death- Clients were offered an insulting figure of $1 to settle their case. We took the case to trial and obtained a gross jury trial verdict of $1,250,000.
Wrongful Death- Clients were told there was no liability and thus, no settlement offer. We were retained and obtained a $1,000,000 settlement.
Wrongful Death- Clients were told there was no liability and no settlement offers would be made. We were retained and obtained a gross jury trial verdict of $5,500,000.
Auto Accident- Insurance company only offered “policy” of $30,000. We obtained a final settlement of $3,347,000.00.
Motorcycle Accident- Other side’s insurance company refused to make an offer. At pre-trial mediation we were able to settle the case for $1,200,000.
Drowning Wrongful Death- Defense attorneys stated in open court and on the record that their client had no liability. They were wrong and one year later and just before trial we settled the case for $900,000.
Auto Accident- Driver runs red light- Other side’s insurance company said our client ran the red light. We obtained a judgment for our client in the amount of $2,759,852.
Dog Bite- Defendant dog owner said the dog attack was our client’s fault. His insurance company initially refused to accept liability. Case settled shortly before trial for $500,000.
Automobile Wrongful Death- Insurance company for other side originally denied fault or responsibility. It later argued there was only $100,000 available to settle the case. One week before trial we “convinced” the insurance carrier that in fact there was $1,000,000 in coverage and they paid it.
Dozens of More Cases Over the Past 25 Years- Since 1986, we’ve handled thousands of personal injury cases. In several dozens of these cases, we’ve been able to help injured consumers who were offered low settlements of $2,500 to $6,000, eventually receive settlements of $30,000 to $120,000 after we were retained and stepped in to help them with their claim.
Our secret to success is to work as hard as we can to make sure the other side follows the law. It takes a great deal of work and effort but in all of the cases it is well worth it. We enjoy helping people and we would enjoy the opportunity to help you too!

So How Can You Find a Good Personal Injury or Wrongful death Lawyer?The “perfect” personal injury and wrongful death attorney is someone who is experienced, has a good reputation, and someone who you can trust. The problem is with more than 1,000,000 lawyers in the United States and 200,000 in California, how can you find such an attorney? What resources are available and which ones can you trust?
Based upon our 25 years of dealing with lawyers and practicing law, here are three good tips that you can use to help find the “perfect” lawyer for you. Remember, after finding a lawyer, make sure to properly interview the lawyer using the suggestions and questions found in our free report entitled, “Nine Questions You Need to Ask Every Lawyer You Interview”. These questions will absolutely help you narrow the selection process.
Personal referrals are a good first start. The first thing we recommend that you do is look for an attorney who is recognized as being one of the “experts” in your town or area. Someone who meets all of the above qualifications and then some.
If you have friends or family who were VERY SATISFIED with their experience with a personal injury lawyer, you may want to start there. If you know a good lawyer who handles other types of legal matters (for example, estate planning or criminal defense), ask him or her for the names and numbers of the top 2 or 3 personal injury lawyers in town. Good lawyers know who they would hire if they needed the “best” personal injury attorney in their area and most lawyers would be happy to share these names with you.
Friends at work and even company supervisors or executives may also be able to provide you with one or more names. People you respect and look up to may also be able to share one or more names. (note that this approach will work for almost any type of legal matter)
If you are unable to get a personal referral using the above method, then go to Martindale-Hubbell (www.martindale.com) or the American Association for Justice (www.atla.org) web sites and do a search for an “AV” rated personal injury or wrongful death attorney in your area. An “AV” rating is a good indicator of the lawyer’s ability, reputation and ethics. It identifies a lawyer and firm as having (1) very high to preeminent legal ability and (2) the highest level of expertise, experience, integrity and overall professional excellence.
[Hint- Please keep in mind that new lawyers (practicing less than 10 years) may not yet be "AV" rated. This doesn't necessarily mean they don't work hard or know what they are doing. We know many new lawyers who are excellent litigators and very good at representing their clients. Whether or not an attorney has a prestigious "AV" rating is simply something to think about and take in to consideration when looking for competent counsel.]
Another good way to find an excellent personal injury or wrongful death lawyer is to contact your local bar association (the local lawyer organization) and for the names and numbers of the current and past two presidents. Call each of them and ask whether or not they handle personal injury or wrongful death cases. In Orange County two of the larger local bar associations include the Orange County Bar Association and the Orange County Trial Lawyers Association.
If they handle personal injury and wrongful death cases, then set up an appointment and use the “9 Questions” report to interview the lawyers. If they don’t handle this type of case, ask them to make a recommendation. Keep in mind that you may not be able to speak directly with the attorney but his or her secretary should be able to share the information with you.

1. Contact Information- Inform your attorney immediately of any change of personal or business contact information such as address, telephone number and email address.
2. Refer To Attorney- Use the phrase, “Please contact my attorney with any questions or comments. Here is his/her phone number”
3. Evidence- Provide your attorney with originals of all documents, items and things that may have any relevance to your case.
4. Honest and Forthright- To protect your legal interest, it is critical that you be honest and forthright with your attorney as to all information.
5. Keep Attorney Updated- Contact your attorney immediately with any new information, new developments, evidence, changes in physical or mental condition, witness information…
6. Keep Things Confidential- Do not discuss your legal matter with anyone without first getting your attorney’s approval. This includes your spouse, family, friends, neighbors, employees or news media. The only communications (oral, written and electronic) which are protected from disclosure are those which take place between an attorney and his or her client.
7. Statements- Do not give any statements, written, recorded, or oral, to anyone, including ANY insurance company, concerning your legal matter without first getting the approval of your attorney.
8. Documents and Communications- Do not sign documents, send letters, initiate/ receive telephone calls or electronic communications (email, text message…) concerning your legal matter without first getting the approval of your attorney.
9. Document Creation- Do not compile information or create documents concerning your legal matter without first getting the approval of your attorney.

When it comes to hiring a lawyer, what you see and hear may not be what you need or get. But before I go on, let me regress for a moment…
This past Thanksgiving we took a family trip to Italy. We ventured to Rome, Florence and Venice. While in Florence, we took the train and visited the leaning tower of Pisa, the third oldest structure in Cathedral Square. Here are a couple of pictures I took of the tower and family.
At first glance, the tower appears unstable and ready to fall over at any time. However, after talking with the guides, we were reassured that because of engineering efforts, it was safe to enter the tower, walk up the stairs and enjoy the view. Here’s a pic of AJ and Garrett at the top.
So what does the Leaning Tower of Pisa have in common with lawyer advertising? Well, simply put, in many instances, things are not as they may seem.
Here’s what I mean…
Many lawyers, who advertise on TV, have never taken a case to trial. Other’s may have the persuasive ability to sell an Eskimo ice (injured consumers dial their number all day long) but they don’t know the first thing about how to properly handle your personal injury or wrongful death case in court. Many have never ever taken a case to trial.
In other late night ads, large out of state law corporations shout out in their message that you may be entitled to money for this or that. They beg you to call their toll free number or you may lose your rights forever. What they don’t clearly tell you, although I would imagine it’s in the small print on the bottom of the ad, is that they are not the firm or lawyer who will handle your case. When you call their number, they “farm” out your case to a lawyer in your area who will be the handling your file.
Many times in both situations, uninformed consumers think they’re getting one thing but end up with another.
And it can get worse. Here’s why…
The big insurance companies keep a database of all the lawyers that bring cases against them. They know which lawyers are well recognized for their legal ability to take a case to trial and maximize its value and, they know which lawyers will roll over and settle the case for only pennies on the dollar because they’re afraid to go to court.
How do we know that? We have contacts who are insurance claims adjusters. We have friends who own insurance agencies. Others are defense attorneys who work for big insurance companies. We hear things. We talk about things. And after 25 years of doing what we do, we know things.
Additionally, what many of you may not know is that back in 80’s, Lisa worked as a defense attorney for a couple of years. She represented several of these large insurance companies. She and her fellow lawyers and insurance claims adjusters knew which lawyers they could play “hardball” with and which trial attorneys they needed to settle cases with.
The sad part about all of this is that most clients never know the difference. Why? Because if the lawyer can sell ice to an Eskimo, chances are, he’s going to be able to sell you on accepting a settlement without you ever knowing that your case is worth much more with a little work, expertise and effort.
So, how can you avoid buying ice? Well, here are several things we’ve learned over the past 25 years of representing injured consumers that you should look closely at.
First, to find a lawyer, avoid random ads and commercials. Ask intelligent people who you respect who they would hire to represent them in a case. Personal referrals are a good way to find a great lawyer.
Another way to find a good lawyer is to visit the site Martindale.com and use their search function. You can drill down to particular practice area in your county. Make sure to look for a lawyer who is “AV” rated (highest rating in ethics and ability).
A third way to find a good lawyer is to contact your local bar association (official lawyer association in any particular town or county) and ask for the names and numbers of the last 3 presidents. Call their offices and see if they handle your type of legal matter. If not, ask them for several names of lawyers who they would trust to handle a similar case for their family. While you’re at it, run all names through the Martindale.com site.
After you find a couple of lawyers to interview, do just that. Meet the lawyers and see who you are most comfortable with. Which lawyer were you able to develop rapport with? httpv://www.youtube.com/watch?v=vNHxdGfIk_4 Whether you realize it or not, most lawyer fees are negotiable. Lawyers in California who offer their services on a contingency fee basis must disclose to a new client that their contingency fees are negotiable.
Now, that doesn’t mean the lawyer you’re meeting with is required to agree to the percentage you suggest, but it does mean that you have the right to suggest a fee that is different (lower) that what the lawyer is requesting that you pay.
